State Insurance Requirements
All registered or operated vehicles must be covered by liability insurance. The Minimum amount of liability coverage required by the state of New Mexico is $25,000 for injury, $50,000 for all injuries, and $10,000 in property damage. Commonly referred to as 25/50/10 coverage.
You are required to carry proof of insurance in your vehicle.
DMV Point System
This state enlists a point system to monitor and penalize driving infractions. If a driver is convicted of traffic law violations, the driver will gain points on their drivers license. If those points reach a state specified amount, their license will be suspended for a predetermined period based on the amount of points gained.
Below is a list of violations and their corresponding point values:
SPEEDING TICKETS
- 6 to 15 mph over 3 points
- 16-25 mph over 5 points
- 26 mph over 8 points
The following violations gain 3 points:
- Careless driving.
- Failure to obey traffic instructions stated on traffic sign or shown by traffic control device.
- Following the vehicle ahead too closely.
Failure to yield right of way in manner required. Vehicle turning left at intersection.
- Failure to yield right of way at yield sign after stop or when emerging from private drive way.
- Certain vehicles must stop at railroad grade crossings.
- Improper backing.
Making improper turn.
- Failure to drive on right side of roadway when required.
- Passing vehicles proceeding in opposite directions.
- Improper overtaking or passing of a vehicle.
- Driving to the left of center of roadway when prohibited.
- Passing where prohibited by posted signs, pavement markings, or hill or curve.
- Passing with insufficient distance allowed for other vehicles or with inadequate visibility.
The following violations gain 2 points:
- Operating with any defective equipment resulting in inability to control vehicle movement properly.
- Operating with defective brakes.
- Failure to signal intention to change vehicle direction or to reduce speed suddenly.
- Giving wrong signal.
- Overloading vehicle with passengers or cargo.
- Failure to restrain child passenger properly.
- Failure to use seatbelt properly.
Passing a school bus. Racing. Reckless driving are all worth 6 points.
When a driver accumulates 7-10 points within 1 year, their license will be suspended for 3 months. If they gain 12 points within 1 year, their license will be suspended for 1 year.
